Privacy Policy and Terms of Use – Volocar
Introduction
Volocar Inc. (“Volocar,” “we,” or “us”) provides an online car rental platform that connects vehicle owners with travelers and locals who want to book those vehicles. Volocar is accessible online, including on volocar.ro and as a mobile app. Volocar websites, the blog, mobile apps, and associated services are collectively referred to as the “Services.” By accessing or using the Services, including by communicating with us or other Volocar users, you agree to comply with and be legally bound by these Terms of Service (“Terms”), whether or not you become a registered user of the Services. These Terms govern your access to and use of the Services and constitute a binding legal agreement between you and Volocar.
These Terms, along with the cancellation policy, non-discrimination policy, applicable insurance terms and certificates, roadside assistance terms, and additional policies (hereinafter “Policies”) together constitute the “Agreement” between you and Volocar (each a “Party” and together, the “Parties”). Volocar also provides a Car Sharing Agreement summarizing the terms of each booking, accessible within the Services for any confirmed bookings, which may be used as proof of reservation.
Geographic coverage: Volocar operates in: Romania, United Arab Emirates, Greece, Italy, France, Germany, Austria, and Switzerland.
Eligibility, Registration, Verification
To access and use certain parts of the Services, you must register for a Volocar account. You must be at least 18 years old and legally able to enter into a binding contract.
By creating an account, you agree to:
Provide accurate, current, and complete information as requested during the registration process;
Update your account data whenever changes occur;
Keep your login information confidential;
Notify us immediately in case of any unauthorized use of your account.
Volocar reserves the right to suspend or terminate accounts that violate these terms or contain false, incomplete, or fraudulent information.
To verify your identity and eligibility, we may request official documents such as a driver’s license, passport, or ID card, as well as driving and/or credit history verification, if applicable.
We may share copies of documents with Volocar partners (e.g., car rental companies) to validate bookings in accordance with GDPR. All data is processed and stored securely according to Regulation (EU) 2016/679.
Fees and Taxes
Fees
Fees for using the Services and other cost structures will be detailed at checkout for guests. You can review the amount for your trip at checkout before submitting a booking request. Hosts can view earnings in the Host Hub and learn more about revenue breakdowns. When you provide Volocar with a payment method, you authorize Volocar, or third-party service providers acting on behalf of Volocar, to store payment data for future use in case you owe money to Volocar. You authorize Volocar to use stored payment data for balances, including trip costs, host and guest fees (e.g., late fees, security deposits, processing fees, claim costs, and related administrative fees). In some cases, our payment processors have arrangements with card networks to automatically update stored payment data when you receive a new card (e.g., replacement of expired, lost, or stolen cards), and we may rely on those updates. Referral credit use is governed by the terms and conditions described here.
Collections
Volocar and its service providers may use all legal means to collect owed amounts, including engaging collection agencies or legal counsel. Volocar or the retained agencies may report account information to credit bureaus. Late payments, missed payments, or other defaults may appear on your credit report. In addition to owed amounts, overdue accounts or chargebacks may incur collection, convenience, and/or third-party fees. If you wish to dispute information reported by Volocar to a credit bureau (e.g., Experian, Equifax, TransUnion), contact help.volocar.com. To dispute agency-reported information, contact the agency directly.
Taxes
In some jurisdictions, Volocar may facilitate the collection and remittance of certain taxes on behalf of or in place of guests or hosts (including, if applicable, Co-hosts), based on current or future tax laws, including marketplace facilitator or car-sharing regulations. Collected and remitted tax amounts, if any, will be separately visible and disclosed to guests and hosts (including, where applicable, Co-hosts) on relevant trip documents and invoices. Where Volocar facilitates tax collection and remittance, hosts may not collect the same taxes related to sharing their vehicle in that jurisdiction. EU Council Directive 2021/514 (DAC7) requires Volocar to report unadjusted gross sales for hosts (i.e., “gross earnings”) defined as transactions without deductions for credits, service fees, refunds, or other amounts. DAC7 is an annual reporting requirement, and Volocar will share your revenue data for the previous year.
Your Commitments
You agree to always use your Volocar account and the Services in accordance with these Terms, applicable laws, and any policies or standards provided by Volocar.
Account Activity
You are solely responsible for all activity under your Volocar account. Keep your account information, including your password, secure. Do not share your password with third parties and accept full responsibility for activities under your account. Notify Volocar immediately if you suspect unauthorized access. We are not liable for failure to protect your account unless you have reported unauthorized access.
Compliance with Law
You are responsible for complying with all applicable laws, regulations, and requirements related to your use of the Services. This may include tax registration, traffic laws, or any other local regulations where you use Volocar.
Providing Accurate Information
You agree to always provide accurate and complete identity, contact, document, and any other required information. Providing false or misleading information may result in suspension or termination of your account.
Financial Responsibility
You agree to pay all amounts owed to Volocar or our partners for use of the Services, including rental fees, insurance, late fees, penalties, and other additional costs related to vehicle usage.
Cooperation in Disputes
You agree to cooperate with Volocar during incident investigations, complaint resolution, or disputes. This may include providing evidence, written statements, or participating in mediation.
No Unauthorized Transfers
You agree not to transfer or assign your Volocar account, rights, or obligations under these Terms to any other person or entity without our prior written consent.
Content
License to Volocar Content and User Content
Subject to your compliance with these Terms, Volocar grants you a limited, revocable, non-exclusive, non-transferable license to access and view Volocar content and user content to which you are lawfully permitted access, solely for your personal, non-commercial purposes. You may not sublicense the license rights granted in this section. No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by Volocar or its licensors, except for the licenses and rights expressly granted herein.
User Content
At our discretion, we may allow you to post, upload, publish, submit, or transmit content via the Services, such as photos of yourself and your vehicle(s), reviews, feedback, and descriptions of yourself, your vehicle, or your trip. By making content available on or through the Services or Volocar promotional campaigns, you grant Volocar a worldwide, irrevocable, perpetual (or for the duration of protection), non-exclusive, transferable, royalty-free license, with the right to sublicense, to use, view, copy, adapt, modify, distribute, transfer, publicly display, publicly perform, transmit, stream, access, and otherwise exploit such content for promoting or marketing the Services. Except as described above for Volocar-host-provided photography, Volocar does not claim ownership of such content, and nothing in these Terms shall be deemed to restrict your rights to use or exploit such content.
Copyright Protection
We respond to notifications of alleged copyright infringement and may terminate Volocar Accounts of repeat infringers in accordance with the U.S. Digital Millennium Copyright Act (DMCA) and similar laws. Google Terms
Certain areas of the Services implement Google Maps/Places services, including the Google Places API. Additionally, to prevent spam and abuse, Volocar uses Google’s reCAPTCHA Enterprise. By using our Services, you agree to Google’s Terms of Service.
Prohibited Activities
In connection with your use or access to the Services, you agree that you will not, and will not encourage or assist others to:
Violate any law, including:
Circumvent or violate any local, regional, national, or international law, court order, airport regulation, tax obligation, or licensing requirement
Post false, misleading, defamatory, or libelous content
Infringe intellectual property rights, including copyrights, trademarks, or patents without prior written consent from Volocar
Damage or dilute the Volocar brand, such as:
Unauthorized use of Volocar’s name, logo, or content
Registering domain names or social accounts confusingly similar to Volocar
Provide false information, including:
Fake names, birth dates, driver’s license details, payment or insurance data
Filing a false claim or registering accounts on behalf of others
Impersonate any person or misrepresent your affiliation
You also agree not to:
Fail to meet financial obligations, such as fees, penalties, or amounts due
Fail to return a vehicle or Extras on time, without valid reason
Complete any transaction outside the platform (to avoid platform fees)
Transfer your account or ID without our permission
Leave vehicles unlocked or with keys inside, unless specifically instructed by Volocar
Harass, stalk, or threaten users, or collect personal data improperly
Discriminate based on appearance, identity, beliefs, origin, or preferences
Initiate legal action against Volocar or users in violation of these Terms
Use the Services for unrelated purposes, like:
Marketing, harvesting data, recruiting users to competitors, or spamming
Interfere with the platform, including:
Uploading viruses or malware, using bots or scrapers, bypassing security
Overloading the system or reverse engineering our software
Violations & Legal Action
Volocar reserves the right to investigate, report, and take legal action (civil or criminal) for any violations of these Terms. We may, without prior notice:
Restrict, suspend, or terminate your Volocar account
Remove hosted content or deny claims
Cancel listings or promotional offers
Take technical or legal action to prevent access
We also reserve the right to deny service to anyone for any lawful reason.
Policy Enforcement
We may review a user’s activity and context before enforcing policies and may use discretion to ensure fair treatment.
Communications
You agree that Volocar may contact you via electronic means (email, app notifications, or Volocar messaging) instead of traditional mail. You also consent to occasional automated calls or SMS for:
Account confirmation
Activity updates
Fraud prevention
Debt collection
Urgent notices
Volocar may share your phone number with service providers, but never with third parties without your consent. Standard messaging or data rates may apply. You may revoke your consent where legally required.
